The Habitation Licence Story (Zie Nederlands beneden)

People reading the many books there are available on the subject of buying a home in Portugal are often confused about the required Habitation licence they have read about. 

Only in 1951 did the Portuguese Goverment decree a law whereby any new construction had to approved before one could move in and legally habitate it. Any house built or rebuilt after this year year should thus, in effect, have this habitation licence, even if it is now derelict. 

Any house or ruin built before 1951, even those which are habitable and lived in do not need it.

With Portugal having scattered around its countryside, millions of the century old ruins and houses so sought after by foreigners, the chance of the favoured object having such a habitation licence is rare.
 

When one buys such an object and rebuilds/extends it (under a building licence), it will be considered as having been rebuilt after 1951 and thus then a Habitation Licence must be applied for before one may legally reside in it. 

(It is rumoured that inside the city of Coimbra are regular habitated houses which are basically rebuilt cattle sheds and are still registered as such ! )

Woonvergunning 
De mensen die de vele boeken lezen betreffende het kopen van een huis in Portugal en lezen over de woonvergunning zijn vaak verward over deze “gelezen” vereisten. 

Vanaf 1951 is hierover in Portugal een wet van kracht gegaan. 

Voor alles wat na 1951 wordt gerenoveerd, wordt verbouwd of nieuwbouw is een vergunning nodig.
Voor alle woningen wel of niet bewoond voor 1951 is dit niet nodig.
 
Op het platteland in Portugal waar zeer oude ruïnes en huizen staan verspreid en welke worden gezocht door buitenlanders, is de kans groot dat men hiervoor geen woonvergunning zal aantreffen. Wanneer u een dergelijk object koopt en verbouwt, zult u allereerst een woonvergunning moeten aanvragen zodat u legaal daar permanent kan bouwen en wonen. 
(Er wordt verteld dat in de omgeving Coïmbra veeloodsen zijn verbouwd tot normale bewoonbare huizen maar als veeloodsen geregistreerd staan.)
